As a rule, marks (such as single tones, jingles, word sequences, crosses, road signs, pictograms etc.) are not protected by copyright. The legal framework for their protection in particular may be found in the trademark legislation as well as in the rules concerning the protection of company names. A graphically arranged logo (a picture mark or a combination of a word and picture) or a theme song (“jingle”) may be considered a copyrighted work, as long as its presentation doesn’t remain trivial (see: www.trademark.ch).
