The owner is responsible for the protection and enforcement of his marks

The trademark owner himself is responsible for the administration and controlling of time limits of a trademark already registered as well as the monitoring and the enforcement of the rights out of the trademark. The control and tracking of nationally and internationally running periods is a fastidious activity, which requires the utmost care and accuracy. In view of now over 600'000 entries (of which indeed not all are valid in the market and used respectively) the legal regulation becomes understandable, according to which the Federal Institute of Intellectual Property (IPI) is not legitimized to examine on its part in each registration procedure, whether an identical or similar third mark exists already or whether the period of protection of a mark expires.
